Please read these Terms of Service and User Policy ("Terms") carefully before using the website inblackm.com ("Website" or "Platform"), operated by INBLACK GAMING CO., LTD. ("the Company," "we," "us," or "INBLACKM"). By accessing the Website, registering an account, or making any transaction on the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, please discontinue use of the Website immediately.

1Definitions

For the purposes of these Terms, the following terms shall have the meanings set out below.

1.1 "Company" or "INBLACKM"

means INBLACK GAMING CO., LTD., the owner and operator of the website inblackm.com.

1.2 "User" or "you"

means any person who accesses, uses, registers for, or conducts a transaction on the Website, whether as a registered member or a general visitor.

1.3 "Services"

means top-up services for games and in-game items, gift cards, social/AI application services, and any other services provided by the Company through the Website, whether currently offered or added in the future.

1.4 "Products"

means in-game currency, virtual items, top-up cards, redeem codes, or any other digital benefits sold through the Website.

1.5 "User Account"

means the account created by a User on the Website for the purpose of conducting transactions and accessing the Services.

1.6 "Game Provider" or "Game Owner"

means the company, game developer, or third-party platform that owns the copyright to the game or service for which the User wishes to purchase top-ups or items.

1.7 "Transaction"

means placing an order, making payment, and receiving any product or service through the Website.

1.8 "Payment Channel"

means any payment method supported by the Website, such as QR PromptPay, credit/debit card, e-Wallet, or other methods designated by the Company.

2Terms of Service

2.1 User Eligibility.

Users must meet the age requirement under applicable law, or have obtained the consent of a parent or legal guardian as required by law, and must have the legal capacity to enter into contracts under Thai law.

2.2 Accuracy of Information.

Users are responsible for entering all information required to complete a transaction — such as UID, ID-PASS, game account number, or any other necessary details — accurately and completely. The Company will process transactions strictly according to the information provided by the User and shall not be liable for any damage arising from incorrect, incomplete, or erroneous information provided by the User.

2.3 Transactions.

Once a User confirms an order and payment is successfully completed, the transaction shall be deemed final, and the order details may not be modified or changed under any circumstances, except where the error is attributable to the Company's own system.

2.4 Processing Time.

The Company will complete top-ups or deliver products within the timeframe stated on the Website. However, such timeframes may be delayed due to system issues on the part of the Game Provider, banks, or payment channels, which are beyond the Company's control.

2.5 Suspension or Cancellation of Service.

The Company reserves the right to suspend, cancel, or refuse any transaction if it is determined that a User has engaged in conduct that constitutes fraud, deception, unauthorized use of a credit card or account belonging to another person, or any act that violates these Terms or applicable law.

2.6 Changes to Pricing and Promotions.

Product prices, discounts, and promotions may be changed without prior notice. The price applicable to a transaction shall be the price in effect at the time the User confirms the order.

3Rights and Disclaimers of INBLACK GAMING CO., LTD.

3.1

The Company reserves the right to amend, modify, add to, or terminate these Terms, in whole or in part, at any time. Any changes will be announced via the Website, and a User's continued use of the Website following such changes shall be deemed acceptance of the revised Terms.

3.2

The Company reserves the right to suspend, restrict, or terminate a User Account without prior notice, where there is reasonable cause to believe that the User has violated these Terms, applicable law, or has caused harm to the Company or a third party.

3.3

The Company reserves the right to refuse to provide services to any particular User, without being required to provide a reason, in order to maintain the safety and integrity of the overall system.

3.4

The Company reserves the right to change, modify, or discontinue any service, product, or feature on the Website at any time, at its sole discretion, without incurring any liability to Users as a result.

3.5

The Company disclaims any warranty regarding the continuity, security, or error-free operation of the Website and the services of third-party Game Providers. The Company acts solely as an intermediary facilitating payment and delivery of products, and is not the developer or operator of any game system.

3.6

All trademarks, logos, and content on the website inblackm.com are the intellectual property of the Company or its licensors. No person may reproduce, modify, or distribute such content without prior written permission.

4Claims and Remedial Measures

4.1 Reporting Channels.

If a User encounters an issue with a transaction — such as non-receipt of a product, a top-up made to the wrong account, or a system malfunction — the User may report the issue through the channels designated by the Company on the Website (such as live chat, email, or a contact form), together with supporting evidence of the transaction, such as the Order ID and proof of payment.

4.2 Claim Submission Period.

Users should report any issue within 7 days of the date of the transaction, in order to allow the Company to investigate and resolve the matter effectively.

4.3 Investigation Process.

Upon receiving a report, the Company will investigate the facts of the matter together with the relevant Game Provider and/or payment channel provider, and will notify the User of the outcome within a reasonable period.

4.4 Remedial Measures.

Where an investigation confirms that the error is attributable to the Company's system, the Company will provide a remedy by one of the following means, as appropriate to the circumstances: redelivery of the product, a refund to the original payment channel, or the provision of credit/a discount for use in a future transaction.

4.5 Cases Where a Refund or Remedy Is Not Available.

Where a redeem code or item has already been successfully used within the Game Provider's system, or where the error resulted from incorrect information (UID/ID-PASS) entered by the User, the Company reserves the right to decline to issue a refund or redeliver the product.

4.6

Users acknowledge that submitting a false or fraudulent claim may result in permanent account suspension and appropriate legal action.

5Liability and Limitation of Liability

5.1

The Company acts solely as an intermediary providing top-up and game item/gift card sales services, and is not the owner, developer, or operator of any game or third-party platform. Accordingly, the Company shall not be liable for any damage arising directly from the operations, policies, or malfunctions of any Game Provider.

5.2

The Company shall not be liable for any delay, damage, or loss arising from an event of Force Majeure, including but not limited to natural disasters, internet outages, malfunctions on the part of banks or payment service providers, cyberattacks, or any other event reasonably beyond the Company's control.

5.3

Where the Company is held liable for any damage arising from its own error, the Company's liability shall be limited to the value of the relevant transaction only, and the Company shall not be liable for any indirect damages, consequential damages, or loss of business opportunity suffered by the User.

5.4

Users are solely responsible for maintaining the security of their User Account, password, and PIN code. The Company shall not be liable for any damage resulting from unauthorized access to a User's account by a third party, where such access is not attributable to any fault of the Company.

5.5

The Company does not warrant that the Website will be free from errors, viruses, or other disruptions at all times, and shall not be liable for any damage arising therefrom, except where such damage results from the Company's gross negligence.

6Other Rights and Terms of Service

6.1 Privacy Policy.

Use of the Website is also subject to the Company's Privacy Policy, which is incorporated into and forms part of these Terms.

6.2 Assignment.

Users may not assign or transfer their rights or obligations under these Terms to any other person without the Company's prior written consent. The Company may assign or transfer its rights and obligations under these Terms to another party as it deems appropriate.

6.3 Severability.

If any provision of these Terms is held to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

6.4 Governing Law.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand.

6.5 Jurisdiction.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Kingdom of Thailand.

6.7

No failure or delay by the Company in exercising any right or enforcing any provision of these Terms shall be construed as a waiver of the Company's right to enforce that provision at a later time.
